What can you do if you receive a planning refusal?
All is not lost if you receive a refusal. There are various options you can opt for dependent on your specific application and some key aspects such as location, whether you are in a conservation area amongst others.
This is a specialist area which many Architectural Practices are not equiped to resolve. What should you do after receiving a refusal?
- Consider the reasons for refusal. Take your time to thoroughly review the whole process as it might be a relatively simple modification that has to be considered thereby reducing potential costs and time delays.
- Linic can review your Refusal Notice and clarify the issues for you - there are specific options that involve the legal aspects of the Refusal that should be considered. Linic has dealt with local authority planners and can directly liaise with the authority to obtain a mutually acceptable scheme.
- Householder Appeal Procedure: If the above fails then this particlaular aspect of the appeal process is baased on the reasons for the refusal of Application. No additional changes can be made. This aspect is decided by the Planning Inspectorate, independant of the Client and the local authority.
- High Court If all fails there is the high court process but the costs are prohibitive for small scale developments.
